FemVive - Platform Use, Roles, and Liability Acknowledgment

By registering on and using the FemVive platform (“Platform"), you (“Entrepreneur" or “User") acknowledge and agree to the following terms:

1. Role of FemVive

FemVive operates solely as a digital platform that connects independent entrepreneurs with third-party vendors offering healthcare and wellness products. FemVive does not manufacture, own, store, distribute, or directly sell any products listed on the Platform.

2. Role of Vendors

All products available on the Platform are supplied by independent third-party vendors (“Vendors").

Vendors are solely and exclusively responsible for:

  • Product quality, safety and efficacy
  • Regulatory approvals, certifications, and compliance with applicable laws
  • Product information, labeling and instructions
  • Order fulfillment, delivery and after-sales service
  • FemVive does not assume any responsibility or liability for the above.

3. Role of Entrepreneurs

As an Entrepreneur, you act as an independent agent using the Platform to facilitate orders. You acknowledge that:

  • You are not an employee, partner, or legal representative of FemVive
  • You are responsible for how you present and promote products to customers
  • You must not make unauthorized claims regarding product performance, medical benefits, or regulatory status

4. No Medical Advice

You agree not to represent yourself as a medical professional or provide medical advice. All product-related information must be limited to what is officially provided by the Vendor.

5. Limitation of Liability

To the fullest extent permitted by applicable law, FemVive shall not be liable for:

  • Any harm, loss, or damages arising from the use, misuse, or consumption of products
  • Any failure, delay, or issue in product delivery or fulfillment
  • Any regulatory non-compliance related to products or vendors
  • Any claims arising from representations made by Entrepreneurs beyond approved materials

6. Indemnification

You agree to indemnify and hold harmless FemVive from any claims, damages, or liabilities arising from:

  • Your misuse of the Platform
  • Misrepresentation of products
  • Violation of applicable laws or these terms

7. Acceptance

By registering on the Platform, you confirm that you have read, understood, and agreed to these terms and accept full responsibility for your activities as an independent Entrepreneur.
